"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.

The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling allegations, he was held in federal detention.

In her decision, the court pointed out that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
